What in the hell isn’t cut and dry about that? In Georgia if you are hit from behind, no matter what the circumstances are, that person is at fault. No discussion necessary.

I can empathize. I was once stopped at a red light in Long Beach/Lakewood. I was actually 3 cars back and was rear ended by a CHP officer. His explanation was that he had received a call and was looking at his computer for more info he “looked up and there I was”.\par

Because there was an officer involved we had to wait for ANOTHER officer to come investigate AND his supervisor. I had to sit there through it all as people stared thinking I had perhaps broken the law and he had forcibly stopped me.\par

To top it off, I get home and the now ex asks why I’m so late. I explain what happened and he responds “You f***ed up the Mustang?” and runs out the door to check the car. I respond “I’m FINE thanks for ASKING!!!”\par

Ah man Kev, it isn’t cut and dried. I’m sorry even with the dude admitting fault. PA and NY have the same no-fault/at-fault laws. I was rear-ended in ‘04 and am still in legal limbo even with a police report assigning blame.

Same thing happened to me in April of last year. I was at a dead stop at the base of an off ramp in a line of cars, when an old man came barreling down the off ramp at 45 mph, slamming into the back of my car. I looked up into my rear view and though the same thing, “Is he going to stop?” So yeah…my poor Ford Taurus was totaled by an 82 year old man in a Jeep Liberty. The accident was 100% his fault, as he immediately admitted guilt. In his own words “I saw you, I just didn’t stop.” Wow…old people really shouldn’t drive. Hopefully it’ll turn out well for you. I have pretty horrible neck pain and I got slim to nothing for my car, but a year and a half later I have a Mini Cooper. So it worked out okay in the end.

I got in a fender bender once. I was a passenger in the car though. So a few weeks later the person’s insurance company called and pretended to be all concerned about me and asked if I was alright. Fucking insurance companies. All they want is money.
