Holy Shit! Is that guy going to stop?
Why no blog today Kevin? Writers block? Nope. Was it burning when you peed? Nope.
Were you dealing with soreness, a fucked up neck, and a potentially totaled car after some dipshit hit you? Yup.
I was on my way back from a commercial shoot for work. It was a nice day out, I was feeling happy about life, in fact you could have said I was downright chipper. (Wow I can’t even believe the bullshit I am shoveling here.)
Basically on Wednesday I was sitting at a stoplight and I looked up in my rear view mirror only to see a min-van with a male driving who was looking off to the side of the road. I thought for a second, “Holy shit that guy isn’t slowing down.” Then of course he rammed into the back of my new car, going about 30 mph. He hit me so hard that my dashboard buckled and the sides of my car dented, not to mention made it so the driver seat can’t sit up anymore.
Right now I am pretty sore and waiting to see a Doctor on Friday as well as his insurance company coming out and taking a look at my un-drivable car. (I’ll post pictures next week.)
Anyways I don’t have a whole lot to share about it as of yet. But I will drop this little nugget on you… Yet another reason to believe that insurance companies are just total scumbags. Here is a snippet from the phone conversation I had with his insurance company.
BigInsuranceDouche: Yeah so we mailed out some forms we need you to fill out.
Me: Can you fax them or e-mail them? I really don’t want this taking two months to finish, it is pretty cut and dry.
BigInsuranceDouche: Well we didn’t think it was cut and dry at first.
Me: I was stopped at a light and a guy rear ended me. What isn’t cut and dry about it? Whatever he admitted fault and got cited.
BigInsuranceDouche: It was lucky for you he did.
Yup, I got lucky that a guy was honest for an obvious accident he caused.
Wait what is that phone number for that injury attorney?

Holy crap! I’m glad you’re okay. That’s some crazy shit.
What a fag. (Not you) The shithead that rear-ended your car! I hope you get a whole new car out of this. Some knuckle-brained idiot was drunk-driving and rear-ended my neighbor’s brand new Honda Civic that he just bought in April of this year. I heard the guy hit it (over the t.v.) and I was sitting here at my computer at the back of my house, and heard the rear bumper of the car get drug a few feet then the truck screetched it’s tires and sped off! Later the cops were able to track the truck because the back bumper of my neighbors car was still hanging off of their truck. To top it all off they are probably illegal aliens. Nice huh? Now my neighbor gets to pay for higher insurance because the dillholes that hit his car were uninsured and are illegal.
Do not talk to the insurance adjuster again, If you even hint you might have done something wrong they will use that to deny your claim. and it will be taped.\par

Keep in mine vehicle damage and medical damage can be seperated so it is possible to settle one and not the other. If you have not done so you need to tell your insurance company – his may not have enough coverage to replace/repair your car and compenstate you for injuries. Your unisured/underinsured will pick up the slack, but you have to give them notice.
Ugh. I got in an accident on my birthday which is May 15th. Still having to settle. My advice is go to a lawyer, especially if they’re even seeming slightly douchy… or is that douche-ish? Either way, Geico (at fault ins) took two weeks to get around to looking at my SUV (I was trying to be nice so I didn’t get a rental in the meanwhile) then they “forgot” to call me to tell me they totaled it. I had to keep calling them, so, now I am waiting to see if litigation will be necessary. I hate accidents, sorry that happened to ya!

Somehow I assume cigar smokin, beer drinking lawyer isnt an automotive/injury lawyer but hes definately right. Dude, dont joke, contact a lawyer to help you. Remember adjusters are NOT your friend, as nice as they seem.

I got in a fender bender once. I was a passenger in the car though. So a few weeks later the person’s insurance company called and pretended to be all concerned about me and asked if I was alright. Fucking insurance companies. All they want is money.

Same thing happened to me in April of last year. I was at a dead stop at the base of an off ramp in a line of cars, when an old man came barreling down the off ramp at 45 mph, slamming into the back of my car. I looked up into my rear view and though the same thing, “Is he going to stop?” So yeah…my poor Ford Taurus was totaled by an 82 year old man in a Jeep Liberty. The accident was 100% his fault, as he immediately admitted guilt. In his own words “I saw you, I just didn’t stop.” Wow…old people really shouldn’t drive. Hopefully it’ll turn out well for you. I have pretty horrible neck pain and I got slim to nothing for my car, but a year and a half later I have a Mini Cooper. So it worked out okay in the end.

even with the dude admitting fault. PA and NY have the same no-fault/at-fault laws. I was rear-ended in ‘04 and am still in legal limbo even with a police report assigning blame.
I can empathize. I was once stopped at a red light in Long Beach/Lakewood. I was actually 3 cars back and was rear ended by a CHP officer. His explanation was that he had received a call and was looking at his computer for more info he “looked up and there I was”.\par

Because there was an officer involved we had to wait for ANOTHER officer to come investigate AND his supervisor. I had to sit there through it all as people stared thinking I had perhaps broken the law and he had forcibly stopped me.\par

To top it off, I get home and the now ex asks why I’m so late. I explain what happened and he responds “You f***ed up the Mustang?” and runs out the door to check the car. I respond “I’m FINE thanks for ASKING!!!”\par

Ah it is all good I don’t want a pity party, I was getting some messages asking why I didn’t post today. Figured this was the easiest way to explain it.
yeah fun and good times
